The Sola Company, and its subsidiaries and affiliates (collectively “SOLA,” “we,” “us,” or “our”) value your privacy and understand the importance of maintaining the confidentiality and security of your information.  This Privacy Policy outlines how SOLA collects, uses, and shares your personal information and the choices and rights that you may have in relation to information. Thank you for taking the time to read and understand our data and privacy related practices. 

 

If you do not agree with or you are not comfortable with any part of this Privacy Policy,  or our Terms of Service,  please immediately discontinue access or use of our Services.

 

  1. APPLICABILITY AND SCOPE

 

This Privacy Policy applies whenever your personal information is processed as part of our “Services”, which means when you visit our website located at www.solasweet.com and all corresponding webpages, software applications, websites or mobile applications that link to this Policy (collectively “Site”), or when you communicate with us via email, texts, a webform or phone call.  

This Privacy Policy applies solely to information collected by SOLA and does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from the Site.  Third parties you interact with may have their own privacy policies, and SOLA is not responsible for how those third parties use the information they collect.  We encourage you to learn about the privacy practices of those third parties.

  1. CHANGES TO THIS POLICY

We may change this Privacy Policy from time to time and we will notify you by revising the “Last Updated” date at the top of this Privacy Policy.  If we change this Privacy Policy in a way that we believe materially affects how we process your personal information, we will provide you with advance notice such as via email or by posting a notice on our website. Unless otherwise required by laws in your residence, your continued access or use of our Services after receiving the notice of changes constitutes your acknowledgment that you accept the updated Privacy Policy.

  1. INFORMATION WE COLLECT

Personal information is generally any information that relates to you, identifies you personally, or could be used to identify you. The types of personal information that we may collect about you, and the way we collect such information is described below.   

Information You Provide Us.  For us to provide our Services, you will need to provide us with certain information. 

  • Account Registration. To order our products, you need to create an account, and provide us with certain information, including your first and last name, email address, and a password.
  • Orders. When you place an order with us, you will need to provide us with certain information so that we can process your order, including your first and last name, delivery address, postal code, email address, phone number. 
  • Payment Information. When you make purchases your payment information will be processed by that third-party application or platform and subject to that third-party application or platform’s terms of service and privacy policy. For these purchases, SOLA does not receive your financial information, but may receive non-financial information related to your purchases, like your name, approximate physical location, and the items purchased.
  • Customer Support. If you contact our support team, we may collect the personal information that you choose to share with us.
  • Product News and Promotions. You may choose to provide us your email address if you wish to receive information about our offers and Services.
  • Web Forms. When you complete forms on our website, you may provide us with certain personal information such as your name, email, and phone number. If you provide contact information, we may contact you to clarify your comment or question, or to learn about your level of interest in, or satisfaction with our Services.

 

Information We Automatically Collect.  

  • Usage Data. When you browse our Services, we automatically collect log data such as your web request, Internet Protocol (“IP”) address, browser type, domain names, referring and exit pages and URLs, pages viewed and the order of these page views, the date and time you access our servers, and other diagnostic data. For more information, see the Cookies and Other Tracking Technology section below.
  • Device Information. When you use your desktop or mobile devices to access our Services, we may be able to identify and collect your device’s unique device identifier, MAC address, operating system, and your mobile device’s advertising ID.
  • Location Information. When you use our Services, we may infer the generic physical location and geographic regions of your device from your Wi-Fi, Bluetooth and other device settings. For example, your IP address may indicate your general geographic region. You may choose not to share your location details with us by adjusting your desktop device’s location services settings. For instructions on changing the relevant settings, please contact your service provider or device manufacturer.

Information from Third Parties.

From time to time, we may obtain information about you from third-party sources unless prohibited by applicable law, such as public databases, marketing partners, social media platforms, event organizers or other publicly available information.

  1. HOW WE USE YOUR INFORMATION

 

We use your information for business and commercial purposes, including to provide the products and services you request, to perform customer service functions, for security and fraud prevention, for marketing and promotional purposes, and to perform analytics.

We may use the information we collect about you in a variety of ways, including to:

(a) To Provide Our Services. We will use your personal information to provide information or perform Services that you request, including managing your request to register an account. For example, when you place an order with us, we require your address to deliver your order. We will not be able to provide you with our Services without such information.

(b) To Communicate With You. We process certain information in order to communicate with you in relation to your accounts, our services, our marketing, and your requests, including to:

  • communicate with you about orders, purchases, services, and account;
  • respond to your customer service inquiries and requests for information;
  • send you personalized promotions, content, and special offers;
  • post your comments or statements on our Site;
  • communicate with you about our brands, products, events, or other promotional purposes;
  • implement your communications preferences, such as sharing information with SOLA business partners so that they may email you about their promotions, products and initiatives.

(c) To Personalize Your Experience. We may process certain information to personalize your experience.  Such personalization allows you to more easily interact with our Services across platforms and devices.

(d) For Research, Development, and Improvement of Our Services. We want to ensure that our Site and Services are continually improving so that we meet your needs and expectations. To do so, we may process certain personal information, including to maintain, improve, and analyze our Site and the Services we offer, and to detect, prevent, or investigate suspicious activity or fraud.

(e) To Enforce Compliance with Our Terms, Agreements, and Policies. To maintain a safe, secure, and trusted environment for you when you use our Services, we use your personal information to ensure our terms, policies, and agreements with you and any third parties are enforced.

(f) To Detect and Prevent Fraud and Security Risks. We may process your personal information to help monitor, prevent, and detect fraud and abusive use of our Service, monitor and verify your identity so that unauthorized users do not gain access to your information, enhance system security, and combat spam, malware, malicious activities or other security risks that might result in financial loss.

(g) To Maintain Legal and Regulatory Compliance. Our Services are subject to certain laws and regulations which may require us to process your personal information. We may be required to process certain personal information under certain laws and regulations, such as tax laws, as well as to  maintain appropriate records for internal administrative purposes; and comply with applicable legal and regulatory obligations, and respond to lawful governmental requests, as needed.

(h) To Facilitate Corporate Acquisitions, Mergers, and Transactions. We may need to process information regarding your account and your use of our Services in the context of corporate acquisitions, mergers, or other corporate transactions.

(i) With Your Consent. We may process your information for any other business or commercial purposes at your direction or with your consent.

  1. HOW WE SHARE YOUR INFORMATION

We share your personal information as needed to fulfill the purposes described in this Privacy Policy and as permitted by applicable law. This includes sharing among SOLA-affiliated entities for internal business purposes, sharing with service providers to help perform business functions at our direction, sharing with your consent, sharing for marketing purposes, sharing as part of corporate transactions, and sharing to protect lawful interests. 

We may share or disclose your personal information in the following circumstances:

(a) When We Work With Our Service Providers. We may share your personal information with third-party service providers acting on our behalf to help us operate our Services.  Service providers and vendors provide us with support services such as credit card processing, order fulfillment, website hosting, analytics, and network maintenance. These third parties can only use your information in accordance with our written instructions. We use Shopify to power our online store. (c) When Sharing Helps Us Protect Safety and Lawful Interests. We may access, preserve, and disclose information about you if we believe doing so is required or appropriate to (i) comply with law enforcement requests and legal processes, such as a court order or subpoena; (ii) comply with requests from auditors, examiners or other regulators; (iii) respond to your requests; or (iv) protect your, our, or others’ rights, property or safety.

(c) When We Work Together. We may share your personal information between and among other SOLA-affiliated organizations for purposes of management and analysis, decision making, and other business purposes.  

(d) When We Work with Marketing Partners. In certain circumstances, and subject to the applicable law, we may share your personal information with third-party advertisers and marketing partners for permitted marketing purposes.

(e) When We Work on Business Transaction or Other Asset Transfers. We may disclose and transfer information about you to buyers, advisors, potential transactional partners, or other third parties in connection with the advisors, potential transactional partners, or other third parties of a corporate transaction in which we are acquired by or merged with another company, or we sell, liquidate, or transfer all or a portion of our business or assets.

(f) When You Give Your Consent. We may share your personal information with other companies if you consent, give us permission, or direct us to do so.

(g)  When You Post on Our Site. If you post information on a blog or another part of our Site, the information that you post may be seen by other visitors to our Site, including your user name.

 

  1. HOW WE MAY ALLOW OTHERS TO COLLECT YOUR INFORMATION

When you use our Site, we may allow third parties to collect device and usage information and location information across your different devices through cookies and other tracking technology.   These third parties collect this information for the following purposes and for other purposes consistent with their own privacy policies:

  • To Display Ads for Products or Services.  We may allow some advertising companies to collect this information so as to display ads that are more relevant to you across your different devices and on our own and others’ websites and mobile apps. Please see the  Your Choices section of this Statement for more information about opting out of targeted advertising.
  • To Understand the Use of Our Services. We allow certain service providers to collect this information so that we can better understand how our Site is used and to assist us in improving the content and operation of our online properties. These service providers collect aggregate statistical usage data that is not matched or linked to any individual user.
  1. COOKIES AND OTHER TRACKING TECHNOLOGY

We and third parties on our behalf may use cookies or similar tracking technologies (collectively, “Tracking Technologies”) to collect information automatically as you interact with our Services.  These Tracking Technologies help us customize your experience, optimize our user experience, or provide you with advertisements of interest to you.   

Cookies are small web files that a site or its provider transfers to your device’s hard drive through your web browser that enables the Site’s or provider’s system to recognize your browser and remember certain information.  Cookies set by us are called “first party cookies”. Cookies set by parties other than SOLA are called “third party cookies”. The parties that set third party cookies can recognize your web browser both when it visits the our website and when it visits certain other websites where the third party’s cookies are also present.  The length of time a cookie will stay on your browsing device depends on whether it is a “persistent” or “session” cookie. Session cookies will only stay on your device until you stop browsing.  Persistent cookies stay on your browsing device until they expire or are deleted. 

We may also use Web Beacons, JavaScript, and Entity Tags to optimize your user experience. 

  • Web beacons are small, transparent images that are embedded in web pages, applications, and emails that are sometimes called “clear gifs," “single pixel gifs", "page tags" or “web bugs.” We may use web beacons track the web pages you visit, to test the effectiveness of our marketing, and to find out if an email has been opened and acted on.
  • JavaScript are code snippets embedded in various parts of websites and applications that facilitate a variety of operations including accelerating the refresh speed of certain functionality or monitoring usage of various online components.
  • Entity Tags are HTTP code mechanisms that allow portions of the Site to be stored or “cached” within your browser and validates these caches when the website is opened, accelerating website performance since the web server does not need to send a full response if the content has not changed.

We may use Tracking Technologies for the following purposes:

  • Functionality. Some of these technologies are required to allow you to access and use our Site, and without them our Site would not work properly.
  • Performance Monitoring. Some of these technologies help us analyze and estimate traffic and assess the volume of use of services and functionality on our Site. When these technologies are used for performance monitoring, no directly identifiable information (e.g., your name, email address or phone number) is collected.
  • User Convenience. Some of these technologies enhance the ease of use of our Site by accelerating load and refresh times and remembering information that you have provided on prior visits to our Site or when you last used our Site.
  • Marketing and Behavioral Advertising. Some of these technologies are used to tailor your experience on our Site, or across your applications or devices by controlling the promotions, advertisements and other marketing messages that may appear when you access or use our Site or other third party sites. We may use Shopify Audiences to help us show ads on other websites with our advertising partners to buyers who made purchases with other Shopify merchants and who may also be interested in what we have to offer. We also share information about your use of the Site, your purchases, and the email address associated with your purchases with Shopify Audiences, through which other Shopify merchants may make offers you may be interested in.

Promotional Communication Choices.  You can opt out of receiving promotional emails and mailings by informing us of your preference at the time you sign up for a SOLA account, or by following the “unsubscribe” instructions in the promotional emails we send you. Please note that if you opt out of receiving promotional communications from us, we may still send you transactional communications, including emails about your SOLA accounts or purchases.  Please note that “unsubscribe” requests may not take effect immediately and may take a reasonable amount of time to receive, process and apply, and please note that any information provided to third parties prior to your election to unsubscribe will not be retrieved or rescinded, unless required by applicable law.

 

Access and Correction.  You can access and correct your personal information that you shared with us on our Site or Services. We are committed to ensuring that your personal information is kept accurate and up to date. However, it is up to you to update it with any changes. You can review and change your personal information by logging into the Site and visiting your account profile page. You may also notify us via the information in the “Contact Us” section below to request access to, or to correct any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

 

Cookies and Other Tracking Technologies.  You may be able to reject cookies and other tracking technologies by adjusting the appropriate settings of you your browser. If you do not want us to deploy cookies in your browser, you may exercise your preference by modifying your web browser setting to either refuse some or all cookies, or notify you and ask for your permission when a website tries to set a cookie. If you want to learn the correct way to modify your browser settings, please use the “Help,” “Tools” or “Edit” menu in your browser or review the instructions provided by the following browsers:  Google Chrome,  Internet ExplorerMozilla Firefox, Safari (Desktop)Android Browser, and Opera.

 

If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out of interest-based targeting provided by participating ad servers through the Digital Advertising Alliance (optout.aboutads.info) or the Network Advertising Initiative (optout.networkadvertising.org). In addition, on your iPhone, iPad or Android mobile device, you can change your device settings to control whether you see online interest-based ads. 

  

Analytics. We may use third-party service providers to monitor and analyze the use of our Site. Presently, we use Google Analytics. Google Analytics is a web analytics service offered by Google LLC (“Google”) that tracks and reports Site traffic. Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics, available at: tools.google.com/dlpage/gaoptout.

 

If you disable or remove cookies, some parts of the Services may not function properly. Information may still be collected and used for other purposes, such as research, online services analytics or internal operations, and to remember your opt-out preferences.

 

  1. DATA SECURITY

 

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All personal information you provide to us is stored on our secure servers behind firewalls. In order to prevent unauthorized access or disclosure, we have put in place multi-layer physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. You should not share your password with anyone. We urge you to be careful about giving out information in public areas of the Site like message boards. The information you share in public areas may be viewed by any user of the Site.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. In particular, email sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via email. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

  1. RETENTION

 

We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. We will also retain Site and services usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Site, or we are legally obligated to retain this data for longer periods. 

  1. CHILDREN’S INFORMATION

 

Our Services are not directed toward and we do not knowingly collected information from children under the age of 16.  If you are the parent or guardian and believe your child has provided us with personal information, please contact us at the address below in the Contact Us section to request deletion.

  1.  NOTICE TO CALIFORNIA RESIDENTS

This section applies only to California residents, and provide the additional details regarding the information defined as “personal information” under applicable California law and related to a California resident or household (“Consumers” and “you”) further referred to as “Personal Information.” This Notice describes the categories of Personal Information that SOLA has collected, the categories of Personal Information SOLA has disclosed, the categories of Personal Information SOLA has sold (if any), and a description of the Consumer's rights. 

We generally collect the following categories of Personal Information about your when you use our Services:

  • Identifiers such as a name, address, unique personal identifier, email, phone number, your device’s IP address, software, and identification numbers associated with your devices.
  • Commercial information such as records of products purchased, obtained, or considered by you.
  • Internet or other electronic information regarding you browsing history, search history, the webpage visited before you came to our Site, length of visit and number of page views, click-stream data, locale preferences, your mobile carrier, date and time stamps associated with transactions, and system configuration information.
  • Your geolocation, to the extent you have configured your device to permit us to collect such information.

For more information about the Personal Information we collect and how we collect it, please refer to Section 3, above. We collect your Personal Information for the business purposes described in Section 4, above. The CCPA defines a “business purpose” as the use of Personal Information for the business’s operational purposes, or other notified purposes, provided the use of Personal Information is reasonably necessary and proportionate to achieve the operational purpose for which the Personal Information was collected or another operational purpose that is compatible with the context in which the Personal Information was collected. The categories of third-parties with whom we may share your Personal Information are listed in Section 5, above.

Notice About “Do Not Track Settings”.  SOLA does not currently take action in response to a “do not track” browser setting. SOLA will revisit this policy accordingly if an industry standard regarding such settings emerges.

Consumer Rights Under California Law.  You may have the following consumer rights. Please note that these rights are not absolute and in certain cases are subject to conditions or limitations as specified under the law:

Right to Access. You have the right to request a copy of the personal information that we collected about you during the 12 months before your request, including the:

  • categories of Personal Information we have collected about you;
  • categories of sources from which we collected your Personal Information;
  • business or commercial purpose for the collecting and disclosing your Personal Information;
  • categories of third parties with whom we shared your Personal Information; 
  • specific pieces of Personal Information we collected about you.

Portability.  You have the right to obtain a list of categories and a copy of the Personal Information, in a portable and (if technically feasible) readily usable format, collected on you covering the 12-month period preceding the request.

Deletion. You have the right to request the deletion of your Personal Information we have collected from you. This right may be subject to certain conditions and limitations under the law.

Right to be Free from Discrimination. You may exercise all of the above rights at all times and we will not unlawfully discriminate against you for exercising your rights under the California law.

Sale of Personal Information. You have the right to opt-out of the sale of your personal information to third parties. SOLA does not sell your personal information within the normal meaning of the word. 

 

Exercising Your Rights.  To exercise the access, data portability and deletion rights described above as a California resident, please Message Us.  You may also contact us as described in the “Contact Us” section below. Before fulfilling your request, as required by law, we may ask you to verify personal information we already have on file to confirm your identity. If we cannot verify your identity based on the information we have on file, we may request additional information from you, which we will only use to verify your identity, and for security or fraud-prevention purposes.

Use of an Authorized Agent to Submit a Request. Only you or a person you formally authorize to act on your behalf, may make a verifiable consumer request related to your personal information as a California consumer. If you use an authorized agent to submit such a request, we will require written proof that the authorized agent has been authorized to act on your behalf or a copy of the power-of-attorney document granting that right.

In addition, California Civil Code §1798.83 permits customers of SOLA who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. In your request, please specify that you want a “SOLA’s California Privacy Rights Notice.” Please allow 30 days for a response.
